Commercial Fence Permits in Virginia & North Carolina: What Businesses Need to Know

Planning a commercial fence permit in Virginia or North Carolina is not the same process a homeowner goes through, and treating it that way is how projects stall. A dumpster enclosure, a security perimeter, or an access-controlled gate on a non-residential parcel triggers different height rules, different permit types, and different zoning review.

Hurricane Fence has worked across Richmond, Hampton Roads, and the Raleigh area for more than 30 years, and we handle this paperwork on every commercial job. Here is what you need to confirm before you build.

Do You Need a Permit for a Commercial Fence?

Anti Crash Aluminum Fence

Short answer: almost always yes, and often more than one.

Most commercial fences need at least a zoning permit, which confirms the fence meets local rules on height, setback, and placement. Some also need a separate fence building permit, which reviews the structure itself. Which ones apply depends on the jurisdiction and the fence’s height.

A commercial fence permit carries more review than a homeowner’s application because non-residential parcels are held to zoning and code standards that a single-family lot often is not. That means a zoning permit fence application for a business gets checked against setbacks, visibility at driveways and corners, and any design rules tied to the property’s zoning district.

The safest move is to confirm requirements with the local building department before you order materials. If you would rather not chase that down, our team assists as part of our commercial fencing work.

Commercial vs. Residential Fence Permit Rules: Why They’re Different

This is where most permit guides get it wrong for a business. They blend homeowner rules with commercial ones, and the two do not match.

On a residential lot, a fence under a certain height is frequently exempt from a building permit. On a non-residential parcel, the thresholds are stricter, and the review is broader. Commercial fencing regulations typically add zoning compliance review, and a taller fence can flip the project from a simple zoning sign-off into a full building permit.

Raleigh shows the difference cleanly. Any fence there needs a zoning permit, but pulling a non-residential fence permit means a commercial fence over 6 feet in height may also require a building permit, per the City of Raleigh fence permit page. A homeowner rarely crosses that trigger. A business installing a security perimeter often does.

If you landed here looking for homeowner rules instead, our residential fence permit guide covers that side.

Virginia Commercial Fence Permit Requirements

Virginia has independent cities and counties, each enforcing its own building code, so a commercial fence permit Virginia business owner has to check the specific locality. There is no single statewide fence permit standard. Here is what the confirmed jurisdictions require.

Virginia Beach. A permit is required for any fence or wall built, replaced, or relocated within 30 feet of a public right-of-way. The Virginia Beach fence and wall permit page lists the fee at $61, and fence permits there do not require a post-installation inspection. A few extra rules apply: a fence enclosing a pool needs a separate building permit, chain link within 30 feet of and parallel to a right-of-way must have Category I landscaping, and gates are required on rear yard fences adjacent to a street. Fence provisions are governed by Section 201 of the City Zoning Ordinance, administered by Zoning Administration at 2403 Courthouse Drive, 757-385-8074.

Richmond. Fences of any height generally do not require a building permit unless the fence is for pedestrian safety under Virginia Residential Code Section 3306, or serves as a pool barrier, per the City of Richmond development FAQ. That exemption applies to commercial and residential parcels alike — a Certificate of Zoning Compliance is typically tied to establishing or changing a business use on the property, not to fence installation itself.

Before any digging, Virginia Beach’s own page directs applicants to contact Miss Utility to mark underground lines. Make that call a required step on every Virginia job.

North Carolina Commercial Fence Permit Requirements

North Carolina works off the statewide North Carolina State Building Code, but individual counties and municipalities enforce it, so fence permits still vary by location. Raleigh is the clearest confirmed example in our service area.

In Raleigh, a zoning permit fence rule applies to every fence: a zoning permit is required whenever a fence is installed on any property, per the City of Raleigh fence permit page. For a commercial fence over 6 feet in height, you may also be subject to a building permit in addition to the zoning permit. Commercial applicants use the Non-Residential Permit Application, and the project is reviewed for compliance with the local development code and the North Carolina State Building Code. Corner and multi-frontage lots draw extra review for visibility.

North Carolina also requires utility lines to be marked before any digging through NC811. Build that locate step into the schedule on every North Carolina job, the same way you would in Virginia.

Licensing & Compliance: What to Confirm Before You Build

A permit is only part of it. The contractor you hire has to be licensed to do the work, and that standard is part of the same commercial fencing regulations a facility manager should vet.

In Virginia, contractor licenses have two parts, per the Virginia DPOR Board for Contractors: a class (A, B, or C) that sets the dollar value of projects allowed, and a classification that sets the type of work allowed. Class A and Class B applicants must provide financial verification, and all applicants complete 8 hours of pre-license education. Our Class A fence contractor designation in Virginia covers the largest projects — triggered when a single contract is $150,000 or more, or when a contractor’s total work within any 12-month period reaches $1 million or more, per §54.1-1100 of the Code of Virginia. The rules sit under Chapter 11 of Title 54.1 of the Code of Virginia and 18 VAC 50-22.

In North Carolina, a general contractor license is required for any project valued at $40,000 or more, in accordance with the NC Licensing Board for General Contractors. Fencing falls under the specialty contractor classification, and applicants pass a Board exam covering the North Carolina State Building Code, estimating, and ethics.

Hurricane Fence holds a Virginia Class A Contractor license (#2705024990). For a fuller checklist, see how to verify if a fence contractor is licensed.
