Virginia Pool Fence Code Requirements at a Glance
Virginia sets the pool barrier rules statewide, and no Richmond ordinance can loosen them. The requirements come from the Virginia Uniform Statewide Building Code, which adopts Section R326 of the 2021 International Residential Code, and from § 15.2-921 of the Code of Virginia. Here is the checklist your barrier has to meet:
- Minimum height: 48 inches (4 feet), measured on the side of the fence facing away from the pool.
- Bottom gap: no more than 2 inches between the ground and the bottom of the fence over grass or gravel.
- Openings: no gap large enough to pass a 4-inch sphere. That rules out wide picket spacing.
- Gates: self-closing and self-latching, opening outward away from the pool, with the latch release at least 54 inches above the ground or otherwise shielded so a child cannot reach it.
- No climbable handholds on the pool side that a child could use to get over.
Every one of these numbers is verifiable in the Virginia pool barrier requirements and the state code. Because the Virginia Uniform Statewide Building Code supersedes local codes, a Richmond inspector is checking against this exact list.

How Tall a Pool Fence Must Be, and the Gate Rules That Fail Inspections

Height is the number everyone knows: at least 48 inches, measured on the outside face of the barrier. What trips up most do-it-yourself pool fences is the gate.
A compliant pool gate has to do three things at once. It has to swing outward, away from the water. It has to close on its own, without pushing. And it has to latch on its own, with the release mechanism at least 54 inches up so a small child cannot reach it. A gate that only meets two of the three still fails.
This is where having your own gate crew matters. Hurricane Fence runs the only in-house gate operator division in Virginia, so the self-closing pool gate is built and hung by the same company that sets your fence, not handed off to a subcontractor who never saw the code sheet.
Which Pool Fence Materials Pass Inspection in Virginia
The code cares less about what your fence is made of than about whether a child can get through it or over it. Two materials clear that bar cleanly and rarely see a warranty callback.
Aluminum Pool Fencing
Vertical pickets give a child nothing to climb, while the picket spacing stays within the 4-inch rule. Ornamental aluminum also keeps an open view of the water.

Vinyl Fencing
Vinyl is a strong option when you want full privacy around the pool, with smooth faces and no footholds.

Wood board-on-board fencing
Wood can be flagged when the horizontal rails on the poolside create a ladder.
Chain Link Fencing
Chain link is legal around a pool in Virginia when the mesh openings stay small, but the diamond weave is climbable, and inspectors look hard at it.
Recommended materials: For Richmond pool projects, we steer toward aluminum and vinyl. You can compare fence materials before you decide.

Pool Fence Permits in Richmond, and Why Yours Needs One
Here is the part that surprises most homeowners. In Richmond, a standard backyard fence requires no building permit.
Pool barriers: A fence required as a barrier around a swimming pool does require a building permit under the City of Richmond permit rules.
Permit paperwork: Hurricane Fence handles the permit paperwork with you and identifies the code requirements at the estimate.
VA811 request: We also make the VA811 dig request, which must be submitted at least three working days before setting a post.
Permits and Inspections office: The city’s Permits and Inspections office is located at 900 E. Broad St., Room 108.
Zoning reviews: Most zoning reviews finish within ten working days, with about half approved the same day.
Old and Historic Districts: If your home is in one of Richmond’s Old and Historic Districts, the fence also needs Commission of Architectural Review approval. Our Richmond fencing team walks you through that.
Permit fee: The permit fee for a pool barrier fence is not published by the city. Contact Richmond Permits & Inspections at 804-646-4169 to confirm.
What a Pool Barrier Inspection Checks

When the inspector comes out, they are working down the same list you saw above. They measure the height at several points along the run, not just at the gate. They check the gap under the fence and the spacing between pickets against the 4-inch rule. They test the gate by hand to confirm it closes and latches on its own, and they check the latch height.
They also look for anything climbable on the pool side. A fence that measures 48 inches but has a horizontal rail a toddler can step on will get written up. Building it to code the first time is the whole point of hiring a crew that installs pool barriers every season.

Frequently Asked Questions
Pool Fence Questions Richmond Homeowners Ask
Do I need a permit for a pool fence in Richmond, VA?
Yes. A pool barrier is the one fence type Richmond requires a building permit for. Standard fences are exempt, but a fence serving as a swimming pool barrier is not, per the City of Richmond. Hurricane Fence prepares the documentation with you and handles the VA811 dig request.
How tall does a pool fence have to be in Virginia?
At least 48 inches (4 feet), measured on the side facing away from the pool. That minimum comes from Virginia’s adopted pool barrier code and applies statewide.
Does a pool fence gate have to be self-closing in Virginia?
Yes, and self-latching too. The gate must swing outward, close on its own, and latch on its own, with the release at least 54 inches above the floor or otherwise shielded from a child’s reach.
Can I use a chain link fence around my pool in Virginia?
It is allowed when the mesh openings stay small, but it is not our first recommendation. Chain link is climbable, and inspectors scrutinize it. Aluminum or vinyl provides an inspection-safe barrier with fewer long-term issues.
How far does a pool fence have to be from the pool?
At least 5 feet from the pool edge under § 15.2-921 of the Code of Virginia. We lay out that setback during the walkthrough so the barrier line is right before we build.
